Ways of proving the evidence as a protector of rights, the manifestation of mercy and effective tools, the realization of justice and one of the most common issues in implementation and the most widely used jurisprudential-legal issues are among the most important methods on which the proof of justice depends on justice. But martyrdom, like other Islamic rules and issues, has rules and conditions, one of which is that, if the testimony is proven, is it conclusive news that the ruler should rule according to it? Is number and justice a condition? What are the pillars of testimony? What are the terms and conditions of testimony? How many witnesses are there? Is the testimony of a witness with an oath acceptable? Another question is what will be the legitimacy of proving the testimony of witnesses or the testimony of a witness with an oath? Therefore, in the present article, which has been written with a descriptive-analytical approach, different dimensions of the subject of martyrdom and its rulings and conditions have been comparatively studied from the perspective of different religions of Islamic jurisprudence and by analyzing the opinions of jurists of five religions in this field The proof of martyrdom and its sub-issues have been studied and finally it has been concluded that the subject of martyrdom in Islam .}, keywords = {Evidence,Finance,Testimonies,five religions}, title_fa = {بررسی های تطبیقی شهادت در امور قضایی از دیدگاه فقهای مذاهب اسلامی}, abstract_fa = {فقه اسلامی در دوره‌های مختلف مظهری از مظاهر عنایت امت اسلامی به شریعت است؛ شریعتی که مبین عدل و رحمت و اصلاح می‌باشد. راه‌های اثبات ادلۀ دعاوی به عنوان محافظ حقوق، مظهر رحمت و ابزار کارآمد، تحقق عدالت و از بیشترین موضوعات در اجرا و پرکاربردترین موضوعات فقهی – حقوقی محسوب می‌شوند که از جمله مهمترین روش‌هایی که اثبات حق و میزان عدالت به آنها بستگی دارد، شهادت است. اما شهادت نیز همانند دیگر احکام و موضوعات اسلامی دارای احکام و شرایطی است که  از جمله آنها این است که، در صورت ثبوت شهادت، آیا خبر قاطعی است که حاکم باید به موجب آن حکم کند؟ آیا تعداد و عدالت شاهد شرط است؟ ارکان شهادت چیست؟ حکم و شروط شهادت چگونه است؟ نصاب شهادت چند نفر است؟ آیا شهادت یک شاهد بهمراه سوگند پذیرفتنی است؟ سوال دیگر اینکه مشروعیت اثبات شهادت شاهدین و یا شهادت یک شاهد بهمراه سوگند چگونه خواهد بود؟ از این رو در نوشتار حاضر که با رویکرد تفسیری-کیفی نگاشته شده است، ابعاد مختلف موضوع شهادت و احکام و شرایط آن به صورت تطبیقی از دیدگاه مذاهب مختلف فقه اسلامی بررسی شده و با تحلیل نظرات فقهای مذاهب خمسه در این زمینه، ضرورت یا عدم ضرورت اثبات شهادت و فروعات مربوط به این مساله بررسی شده و در نهایت به این نتیجه رسیده است که موضوع شهادت در اسلام و نقش آن در اثبات احکام اسلامی مورد توافق تمام فقهای اسلامی بوده و در بسیاری از موارد با هم اتفاق نظر دارند؛ البته در برخی موارد نیز مبانی فقهی هر مذهب اقتضاء می­کند که در برخی موارد با هم اختلاف نظراتی داشته باشند}, keywords_fa = {ادله اثبات,امور مالی,شهادات,مذاهب خمسه}, url = {https://jou.spsiran.ir/article_152528.html}, eprint = {https://jou.spsiran.ir/article_152528_4482646653b8153c9b137bea7aa5dc54.pdf} }
