This fledgling institution was established to facilitate and prosper commercial transactions, because the development and fertility of business relationships and activities are always achieved in the history of mutual trust, reputation, expertise, speed and security. According to Islamic jurists, the contract that the representative concludes in his own name and on his own account and on his behalf is one of the examples of representation in general. By concluding a contract between the agent and the third party, the original becomes committed and entitled, and a direct legal relationship is established between the third party and the original. Hence, the contract of labor rights in the sense that is introduced in the law of Western countries and related countries, which consider labor rights as a kind of representation without representation, according to which there is no direct legal relationship between the original and the third party, in law. Islam is not an example of representation and advocacy; Because in Islamic law, first of all, power of attorney is one of the examples of representation and the relationship between representation and power of attorney is absolute contrary to the law of other countries, general and special, not my general and special aspect. In order to clarify the jurisprudential and legal nature of the right to work, we decided to study the jurisprudence and law of the right to work}, keywords = {Right to Work,Jurisprudence,five religions}, title_fa = {تبیین فقهی و حقوقی حق العمل کاری و مقایسه آن در مذاهب خمسه}, abstract_fa = {حق العمل کاری نهاد نوپایی است که در مآخذ فقهی مذاهب خمسه سابقه ای نداشته است. این نهاد نوپا، جهت تسهیل و رونق معاملات تجاری پا به عرصه وجود گذاشت ،چرا که همواره توسعه و باروری روابط و فعّالیّت ها تجاری در سابقه اعتماد متقابل ، شهرت ، تخصص، سرعت و امنیّت در آن به دست می آید. به اعتقاد فقیهان اسلامی، قراردادی که نماینده به نام خود و به حساب اصیل و از طرف وی منعقد می کند از مصادیق نمایندگی به طور کلی است . با انعقاد قرارداد بین نماینده و شخص ثالث ، اصیل متعهد و ذیحق میگردد و رابطه حقوقی مستقیمی بین ثالث و اصیل برقرار می شود. از این رو ، قرارداد حق العمل کاری به مفهومی که در حقوق کشورهای غربی و وابسته با آن مطرح است که حق العمل کاری را نوعی وکالت بدون نمایندگی می دانند که به موجب آن رابطه حقوقی مستقیمی بین اصیل و شخص ثالث ایجاد نمی شود ، در حقوق اسلام از مصادیق نمایندگی و وکالت به شمار نمی روند؛ زیرا در حقوق اسلام اولا، وکالت یکی از مصادیق نمایندگی است و رابطه نمایندگی و وکالت بر خلاف حقوق کشورهای دیگر عام و خاص مطلق است نه عام و خاص من وجه و به همین دلیل با فقدان وصف نمایندگی ، وکالت نیز منتفی می شود.در همین راستا جهت روشن شدن ماهیت فقهی وحقوقی حق العمل کاری بر آن شدیم با روش توصیفی- تحلیلی بر پایه اطلاعات کتابخانه ای واسنادی به بررسی فقهی، حقوقی حق العمل کاری پرداختیم.}, keywords_fa = {حق العمل کاری,فقه و حقوق,مذاهب خمسه}, url = {https://jou.spsiran.ir/article_155742.html}, eprint = {https://jou.spsiran.ir/article_155742_5b4dc5ec16114060b650a55c3ea4d921.pdf} }
