According to Iranian law, because oil and gas resources are part of public wealth, the right to sovereignty over resources is the responsibility of the Iranian government, so it is concluded through the method of reciprocal sale. Therefore, with the analytical-descriptive method and in the form of a library, we try to examine the reciprocal sales contracts related to the oil and gas industry in order to make the necessary structural adjustments and adjustments to achieve optimal conditions and mechanisms. Research shows. Due to the nature of the laws of the Islamic Republic of Iran, reciprocal sale agreements are appropriate and thus neither the oil and gas industry is dominated by foreigners nor the government loses its dominance over oil and gas resources. The interests of both parties to the contract are secured. In the present study, we will explore these contracts and provide solutions for concluding cross-selling agreements as well as possible, including the enactment of new laws in accordance with current conditions and legal-commercial principles.}, keywords = {Buyback "," Oil"," Gas "," policy"," Iran}, title_fa = {قرارداد بیع متقابل در صنعت نفت - گاز و نقش آن در سیاست گذاری های ایران}, abstract_fa = {قرارداد های بیع متقابل باعث انتقال تکنولوژی به کشورهای در حال توسعه می‌شود، سپس برای توسعه میادین نفت و گاز و گسترش سرمایه گذاری در این حوزه وزارت نفت و گاز چاره ای جز انعقاد قراردادهای بیع متقابل با سایر دولت ها و شرکت های خصوصی خارجی ندارد. بر اساس قوانین ایران چون منابع نفت و گاز جزء ثروت های عمومی محسوب می شود، حق حاکمیت بر منابع بر عهده حکومت ایران می باشد به همین جهت از روش بیع متقابل منعقد میگردد. فلذا با روش تحلیلی – توصیفی و به صورت کتابخانه ای سعی داریم قراردادهای بیع متقابل در ارتباط با صنعت نفت و گاز را در جهت انجام اصلاحات و تعدیلات ساختاری لازم برای رسیدن به شرایط و ساز و کارهای بهینه مورد بررسی قرار دهیم.تحقیقات نشان می دهد که با توجه به ماهیت قوانین جمهوری اسلامی ایران، قراردادهای بیع متقابل مناسب بوده و از این طریق نه تسلطی بر صنعت نفت و گاز از طرف خارجیان صورت می گیرد و نه حکومت تسلط خود را بر منابع نفت و گاز از دست می دهد از این طریق منافع دو طرف قرارداد تامین می گردد. در پژوهش حاضر این قراردادها را مورد کنکاش قرار داده و راه کارهایی برای انعقاد هرچه بهتر قراردادهای بیع متقابل ارائه خواهیم داد که از جمله آنها وضع قوانین جدید متناسب با شرایط امروزی و اصول حقوقی – تجاری می باشد.}, keywords_fa = {بیع متقابل "," نفت"," گاز "," سیاست گذاری"," ایران}, url = {https://jou.spsiran.ir/article_157173.html}, eprint = {https://jou.spsiran.ir/article_157173_87d016bfc963d0862c1de8e17959c99f.pdf} }
