At the same time, some believe that customary international law also recognizes the right to self-defense against an imminent attack. After the September 11 incident and the spread of the cross-border threat of terrorism, some countries try to assign the title of terrorist to their opposition groups and resort to force against these groups even in the territory of other countries. A group of jurists presented the theory of "preventive legitimate defense" in the form of an expanded interpretation of Article 51 of the Charter to deal with non-urgent terrorist threats. The question is, can this theory be defended according to the procedure and principles and methods of legal interpretation? The answer is that interpretative theories do not support this legal approach, and no unified practice has been developed to support this theory by governments or international institutions; But this assessment does not mean ignoring the necessity of providing a legal solution to fight terrorism.
