Manifestations of Restorative Justice in the Iranian Criminal Policy Dispute Resolution Council (Opportunities and Challenges)

Abstract

Restorative justice is a new method in criminal justice that, unlike traditional methods, such as punitive justice and rehabilitation justice, tries to resolve issues arising from the commission of a crime through negotiation and reparation of damages and the establishment of peace and reconciliation. The purpose of this study is to answer the question of what is the place of restorative justice in the Dispute Resolution Council and basically, have the teachings of restorative justice in the Dispute Resolution Councils been considered by those in charge of criminal policy?
This research has been done by descriptive-analytical method and with available library resources and internet resources. The research findings underline the hypothesis that dispute resolution council courts have played a role in providing and expanding criminal justice through mediation between the offender and the victim and encouraging the offender to compensate the victim and resolve many cases in the judicial system. They do. The results showed that restorative justice strategies reform and return the offender to society without the label of guilt and increase the sense of responsibility and compensation of the victim without entering into a lengthy litigation process and increase social solidarity and psychosis and reduce cases and consequently Reduced crime rates.
