Laws and Guarantees for the Implementation of Crimes in the Field of Privacy in Cyberspace in Iran

Abstract

Considering the indescribable expansion of messengers and their users of nearly 40 million and the emphasis of the Supreme Leader of the Islamic Revolution on maintaining the security of privacy in domestic media, explaining the jurisprudential and legal principles of privacy and its relationship with governance in domestic media and its consequences. This is research. We also try to defend the right to privacy and the right of sovereignty to access the information and data of individuals in the internal media in order to maintain security and social order and prevent harm to society, which is one of the other objectives of this study. This article examines the laws that overshadow the penalties and crimes of privacy in cyberspace. In the present study, a descriptive-analytical method is used. The method of data collection is library and the tools of data collection are books, articles, software, CDs and so on. The results showed that we have many gaps in the protection of privacy in cyberspace in the field of legislation and even basic and ordinary legislation, and in the field of civil rights, criminal procedure and criminal protection, we need reforms.
