Abstract

"Amin" has an important religious and legal status and responsibility in advancing the policy of the Islamic society, the protection of which, especially in serious matters, is obligatory from the point of view of Sharia and reason, and whatever causes it to go out is a kind of disruption of the divine and forbidden system. Is. Verses that indicate the absolute fulfillment of trusts, including Mazun, by the owner and the Shari'a, and which prohibit betrayal in it, have made the trustee responsible for it; Preventing the position of the accusation and its consequences is a necessary and rational thing for the trustee and trustee, for which the rules of jurisprudence and law can be a guarantee of execution. Examination of verses, narrations, jurisprudential chapters, legal examples and more importantly, the way of life among the wise are among the arguments that can be focused on creating a "rule of prohibition of the trustworthy beneficiary" in the explanation of the obligatory sentence and situation. Due to the high number of trustees in trust positions such as deposit, power of attorney, company, Mudaraba and governance and other areas, the establishment of this rule has an important impact on preventing systemic corruption of trustees, especially officials, managers, representatives, lawyers and. .. in the Islamic society to maintain the basis of trust and prevent any betrayal.
