Abstract

The issue of the wife leaving the house with the permission of the husband is one of the rights and duties between the spouses, which is disputed by the jurists in Islamic law. There are two views in this regard; Well-known jurists consider the permission of the spouse to be absolutely obligatory, and others have restricted it to not contradicting the pleasures of the spouse. This research, which has been organized by analysis method, is in order to answer the question whether the appointment of a couple as the head of the family in Iranian jurisprudence and law will not lead to unconditional domination and authority of some men? Especially in the contemporary world where women, like men, have taken on many social tasks and obedience is not possible for them at any time, will not provide the means to abuse the right? The author is of the opinion; First, even assuming the acceptance of the first view, the first sentence of the couple's consistency is changeable in the case of secondary titles; إ The husband's permission for the wife to leave the house is considered as an example of the husband's rights and is considered as one of the effects and requirements of marriage; Therefore, it can be adjusted and limited with the condition during the contract.
