The Impact of Intervention Agents' Behavior on Committing Offenses against Individuals

Abstract

The specific complexity of criminal cases for convicting a criminal and who ultimately must be held accountable for their behavior is assumed to have been influenced by several individuals as a result of the crime. Attention legislator on the effect of behavior in one hand and numerous theories of jurists on the role of effect of behavior on approving the responsibility on the other hand, have developed the notion that responsibility is in effect, while contrary to the belief in Islamic Penal Code 1392, the basis of a conviction for effective behavior in responsibility is conduct with fault. This research is a library and documentary method in which process to achieve the purposes and information required by reference to the entry books as well as criminal cases related to the matter the responsibility of causality and by extracting the procedure governing the judicial process has been taken. Investigations to understand the impact of behavior on imposing criminal responsibility on causality have shown that in the criminal regulations a change in the concept causality relationship has been made by the legislator and that its scope includes the material and psychological elements of the crime. Contrary to the notion that responsibility is a mere function of impact, this notion has been moderated. Since the effect of the behavior of the factors involved in the crime is necessary to understand the cause of the behavior, the present study will show that mere behavioral influence is not sufficient to impose criminal responsibility.
