Abstract

Background and purpose: The purpose of this study is to investigate the factors affecting the structure of criminal policy with a differential approach to the crimes of the armed forces.
Materials and methods: The research method in this research is descriptive-analytical through library studies, including books, articles and researches that are related to the subject and in line with the research objectives.
Ethical considerations: In this research, the authenticity of the texts, honesty and trustworthiness have been respected.
Findings: In the criminal policy adopted by the legislator for the crimes of the armed forces, mainly due to the importance of the structure of the armed forces and also the effect of crimes in the mentioned area on the society, factors such as the speed of investigation, the severity of the punishment are considered among the important components. As in some military crimes, the level of the legislator's dealings with the criminals is very severe.
Conclusion: In Iran's penal system, in the field of military legislation, no special role is given to a specialized legislator, otherwise there should be no major changes in the law in such a short period of time considering the conditions governing the armed forces and the clarity of all dimensions and description of their duties.
