Abstract

In recent years, the country's economic policies in the framework of economic development programs are moving towards privatization, and the transfer of activities to the private sector requires individuals to establish various companies and carry out business activities. Have reduced the government's ownership of economic affairs.
A company is formed when two or more people intend to form it, so their intention is the criterion for formation, but in terms of administrative rules and regulations, it is necessary to go through several steps to establish a company or institution so that the company is on paper. To be written and registered in the offices of the Companies Registration Office.
Article 20 of the Commercial Code divides the types of commercial companies into seven types: 1 joint stock companies 2 limited liability companies 3 cooperatives 4 joint stock companies 5 non-joint stock companies 6 relative companies 7 production and consumption cooperatives The registration of such companies in Tehran is the responsibility of the registration office Companies and in the city is in the central registration office. In this research, an attempt has been made to address the conditions for forming commercial companies and not registering them legally.
