Abstract

Despite its long history, the crime of disrupting the economic system of the country has been in the headlines of the media in recent decades and has attracted the attention of jurists. According to the laws of our country, it is influenced by Islamic jurisprudence, and the jurisprudence-legal basis is in most of criminal crimes, especially in the field of Economic crimes are evident. Therefore, investigating the impact of jurisprudence on the criminal policy of such crimes is something that is investigated. This research aims to explain the shortcomings and gaps in the legal criminal policy with the disruption in the country's economic system and the disorder that This policy has been created in the judicial procedure,. The method of this article is descriptive-analytical and uses library resources. The findings show that Iran's criminal policy in dealing with these crimes is different from other crimes and the legislator has tried to put a repressive method in the fight against these crimes. At the same time, the most important challenges of Iran's legal-judicial criminal policy in dealing with disruptions in the country's economic system are the multiplicity of legislative authorities,.Economic Law of the country was approved in 1369, and as a result, there have been two interpretations and interpretations of existing laws in this field, especially the existence of Article 167 of the Constitution and the opinions of jurists are among other challenges that have caused problems for the courts in the field of economic crimes.
