Abstract

A family dispute is a legal action resulting from unresolved disputes between members of a family, which begins with a petition. This research aims to analyze women's experiences based on a semi-structured interview with women referring to the family court (22 samples from Kerman city) and with thematic analysis technique, and to answer the question that "women in the family litigation process with What quality do they experience the common approach in civil procedure law?"
Based on the findings of the research, women's experiences in the judicial process take place on two levels, individual and structural. At the micro level, women's experiences in relation to activists are formed, which was formulated under the main category of "individual level". Another main category was called "structural level", which includes women's experiences of the existing laws and structures in the family litigation system in Iran. In this, the structural level is considered the most important category. The result of this research is that in Iran's legal system, there are shortcomings and ambiguities in the scope of the content of the laws and the implementation of court decisions based on the common approach of civil proceedings, which shows the intensification of hostilities by referring the family to the court, and it is necessary to reconsider this matter. to be
