Abstract

Analyzing the legal requirements of violating family privacy is a topic that is analyzed in this article. Privacy as a modern concept arising from the fundamentals of fundamental rights and human rights has entered various areas of human life. One of these important areas that is the fundamental unit in the formation of a large society is the family. In this field of legislation, it is necessary to pay attention to this institution by adopting a different policy in the system and try to solve its challenges. It seems that the legislator should reach logical conclusions to establish rules in limiting or expanding the scope of privacy. The basics of legislation in the field of family law have been discussed from two philosophical and legal perspectives. From the philosophical point of view, the opinions of the thinkers are presented and the criminological analysis of the topic is presented. Therefore, the presuppositions and principles must be observed to achieve the desired results. Human rights requirements must also be met. For this purpose, the family should be a place for the growth and excellence of human personality. In this article, the author has explained the topic in a descriptive and analytical way.
